None of you have saved much money. If neither spouse has significant assets or property in the name of these spouses, it is rare for a marriage agreement to be useful, as asset protection is the main purpose of a prenupe. The courts will not require a person to do all the housework or to have the children raised in a particular religion.  In recent years, some couples have included social media provisions in their marriage contracts and have set rules on what can be posted on social media during the marriage, and in case the marriage is dissolved.  The 2010 Supreme Court`s Radmacher/Granatino trial overturned the legal framework for recognizing the changing social and judicial views on the personal autonomy of married partners.   Pre-marriage agreements can now be applied by the courts within their discretion in financial settlement cases under Section 25 of the Matrimonial Causes Act 1973, as long as the three-tiered cycling test is completed and is considered fair in the interests of each child in the family.  Preliminary contracts in Canada are subject to provincial legislation. Every province and territory in Canada recognizes marital agreements. For example, in Ontario, marital agreements are called marriage contracts and are recognized by Section 52 of the Family Law Act.  Premarital mediation is another way to create a marital agreement. In this process, a mediator facilitates an open discussion between the couple on all kinds of marriage issues, such as expectations regarding post-birth work and savings and spending styles, as well as traditional pre-marital discussions on real estate sharing and spousal assistance when the marriage is over. The engaged couple makes all decisions about what would happen in the event of separation or divorce with the help of the mediator. They then design either a memorandum of agreement or a pre-marital agreement and have them checked by their respective lawyers. A developed agreement on mediation is usually cheaper because fewer hours are spent with lawyers, because the couple made all the decisions together, instead of one side against the other. If both partners choose not to have a lawyer, they may waive the right of legal representation.
